Terms of service
These Terms of Use (the "Terms") set out the conditions for using the online store provided by the Company on this website (the "Service"). Registered users ("Users") agree to use the Service in accordance with these Terms.
Article 1 (Scope)
These Terms apply to all matters relating to the use of the Service between Users and the Company.
In addition to these Terms, the Company may establish other rules and guidelines for the Service (collectively, "Supplementary Rules"). Regardless of their title, Supplementary Rules form part of these Terms.
If these Terms conflict with any Supplementary Rules, the Supplementary Rules take precedence unless they state otherwise.
Article 2 (Registration)
Registration is complete when an applicant agrees to these Terms, applies for registration by the method specified by the Company, and the Company notifies the applicant that the application has been approved.
The Company may decline an application for registration in any of the following cases, and is under no obligation to disclose its reasons:
(1) False information was provided in the application
(2) The application is from a person who has previously violated these Terms
(3) The Company otherwise deems the registration inappropriate
Article 3 (User ID and Password)
Users are responsible for managing their own user ID and password for the Service.
Users may not transfer, lend, or share their user ID and password with any third party under any circumstances. When a login is made with a user ID and password that match the registered information, the Company will treat it as use by the User who registered that ID.
The Company is not liable for any damage arising from the use of a user ID and password by a third party, except where caused by the Company's willful misconduct or gross negligence.
Article 4 (Sales Contract)
A sales contract is formed when a User places a purchase order with the Company and the Company notifies the User that the order has been accepted. Ownership of the product transfers to the User when the Company hands the product over to the carrier.
The Company may cancel the sales contract without prior notice to the User in any of the following cases:
(1) The User has violated these Terms
(2) Delivery cannot be completed because the address is unknown or the recipient is absent for an extended period
(3) The Company otherwise determines that the relationship of trust with the User has been compromised
(4) Payment methods, shipping methods, order cancellation procedures, returns, and similar matters relating to the Service are governed by the separate rules set by the Company.
Article 5 (Intellectual Property)
Copyright and all other intellectual property rights in product photographs and other content provided through the Service (the "Content") belong to the Company and other rightful owners, including content providers. Users may not reproduce, repost, modify, or otherwise make secondary use of the Content without permission.
Article 6 (Prohibited Conduct)
When using the Service, Users must not engage in any of the following:
(1) Conduct that violates laws or public order and morals
(2) Conduct related to criminal activity
(3) Conduct that infringes copyrights, trademarks, or other intellectual property rights contained in the Service
(4) Conduct that damages or interferes with the functioning of the Company's servers or network
(5) Commercial use of information obtained through the Service
(6) Conduct that may interfere with the operation of the Company's services
(7) Unauthorized access, or attempts at unauthorized access
(8) Collecting or storing personal information about other Users
(9) Impersonating another User
(10) Directly or indirectly providing benefits to antisocial forces in connection with the Company's services
(11) Any other conduct the Company deems inappropriate
Article 7 (Suspension of the Service)
The Company may suspend or interrupt all or part of the Service without prior notice to Users in any of the following cases:
(1) Maintenance, inspection, or updates of the computer systems used for the Service
(2) Provision of the Service becomes difficult due to force majeure such as earthquake, lightning, fire, power outage, or other natural disaster
(3) Computers or communication lines stop due to an accident
(4) The Company otherwise determines that providing the Service is difficult
The Company is not liable for any disadvantage or damage suffered by Users or third parties as a result of the suspension or interruption of the Service, for any reason.
Article 8 (Restriction of Use and Deregistration)
The Company may, without prior notice, restrict a User's use of all or part of the Service or cancel the User's registration in any of the following cases:
(1) The User has violated any provision of these Terms
(2) The registered information is found to contain false information
(3) The credit card registered by the User as a payment method has been suspended
(4) The User has failed to pay fees or other amounts due
(5) The User has not responded to communications from the Company for a certain period
(6) The Service has not been used for a certain period since the last use
(7) The Company otherwise deems the User's use of the Service inappropriate
The Company is not liable for any damage to Users arising from actions taken by the Company under this Article.
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer of Warranties and Limitation of Liability)
The Company does not warrant that the Service is free from defects, whether factual or legal (including defects, errors, or bugs relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security, and infringement of rights).
The Company is not liable for any damage incurred by Users arising from the Service. However, this disclaimer does not apply where the contract between the Company and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act of Japan. Even in that case, the Company is not liable for damages arising from special circumstances (including where the Company or the User foresaw or could have foreseen the damage) among damages caused to the User by the Company's breach of contract or tort due to negligence (excluding gross negligence).
The Company is not liable for any transactions, communications, or disputes arising between a User and other Users or third parties in connection with the Service.
Article 11 (Changes to the Service)
The Company may change the content of the Service or discontinue the Service without notice to Users, and is not liable for any damage to Users arising from such changes or discontinuation.
Article 12 (Changes to These Terms)
The Company may amend these Terms at any time without notice to Users when it deems necessary. A User who begins using the Service after these Terms have been amended is deemed to have agreed to the amended Terms.
Article 13 (Personal Information)
The Company handles personal information obtained through the use of the Service appropriately in accordance with its Privacy Policy.
Article 14 (Notices and Communications)
Notices and communications between Users and the Company are made by the method specified by the Company. Unless a User submits a change of contact details in the manner separately specified by the Company, the Company will treat the currently registered contact details as valid and send notices and communications to them, and such notices and communications are deemed to have reached the User at the time they are sent.
Article 15 (No Assignment of Rights or Obligations)
Users may not assign their position under the usage agreement or any rights or obligations under these Terms to a third party, or offer them as security, without the Company's prior written consent.
Article 16 (Governing Law and Jurisdiction)
These Terms are governed by and interpreted in accordance with the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods does not apply to the Service.
Any dispute arising in connection with the Service is subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
